Edwards, City Attorney <br />SUBJECT. • Settlement of Fantasy Topless Case <br />STATEMENT OF THE FACTS: <br />0 <br />Date: May 30, 1991 <br />Attached is an Agreement which will settle the case against Fantasy Topless. <br />By the terms of the Agreement, the case will be dismissed, each party will bear its own <br />attorney's fees and costs, including costs on appeal and each parry releases the other of all <br />claims for acts or omissions occurring prior to the Settlement Agreement being made. <br />The City of Rancho Cucamonga had a similar case to Colton's. The City of Rancho Cucamonga <br />has made substantially the same Agreement of Settlement as in here proposed. <br />In my opinion, the risks of continuing the case outweigh the benefits to be expected. In my <br />opinion, it is in the best interest of the City to make the settlement. <br />RECOMMENDATION: <br />Staff recommends adoption of the attached Resolution approving the proposed settlement. <br />Attachment: Settlement Agreement <br />Resolution <br />�aii5 <br />qFILE fl.� Do�-_--------------- <br />
