Sotelo, City Manager SUBJECT: Date : 3/7/91 City Council Authorization To Accept Dedicaiion Of Park Property In Lieu Of Fees BACKGROUND John Reichel, of Sunwest Enterprises Comparry, has o,,�`'ered to dedicate to the City five (S) acres of land in corrsideration of the City allowing him to dedicate property instead of paying a fee. The following actions have occurred in consideration of this request: - On January 15, 1991 the City Council ordered that the item be presented to the Parks and Recreation Commission and the Planning Commission prior to a decision being rendered by the City Council. - On January 23, 1991 the Parks arrd Recreation Commission considered the land dedication request and approved the project by an a,,�''irniative vote with one abstention. - On February 12, 1991 the Planning Commission considered Mr. Reichel's dedication o,�j`'er and approved the project by an a,,�''irmative vote with one opposing vote (S to I). - On February 19, 1991 the item was placed on the City Council Agenda for consideration. Mr. Reichel submiaed correspondence requesting that the item be delayed until the subsequent Council meeting to allow the introduction of additional informotion. The Ciry Council granted Mr. Reichel's request and held the item until the next meeting. Since the last City Council meeting, Mr. Reichel has advised that the issue of accepting land in lieu of park development fees for his project was agreed to by the previous City Manager, Leslie Keane Stranon. Mr. Reichel went on to add that the agreement is documented in the Subdivision Agreement for Tentative Tract Maps 14158 and 14159 and Parcel Map 12677 that was approved by the Council, in concept, at the August 1S, 1989 meeting.
