Aguilera, Director of Community Developments , G SUBJECT: Refund of Park Fees (Construction Tax) to Southern Pacific Transportation Company. E BACKGROUND: On May 7, 1991, the Planning Commission approved the development of a 96,000 square N foot metal building to house a Southern Pacific Transporation Company repair facility at the southeast corner of the Interstate 10 freeway and Pepper Avenue. The Southern Pacific Transportation Company subsequently submitted the detailed plans to the Building Division, and received a permit for the improvements, on February 3, 1991. The fees that were paid by the Company on that date included a "park fee", in the amount of $30,606.91, levied on the construction of the facility. On February 6, 1992, the City received a letter from the Southern Pacific Transporation Q Company requesting the refund of the "park fees" since the railroad management had determined that it will not proceed with the construction of the facility. The determination was based upon the lack of funds and increasingly declining revenues from railroad operations. ANALYSIS AND IMPACTS: R Since Park Fees are based on a project's impact to the City's park and recreational facilities, and with the railroad's determination not to proceed with the project, the Planning Division concurs with the request for refund of park fees to the Southern Pacific Transpor- tation Company and recomends the refund of $30,606.91 to the company. RECOMMENDATION: P Staff recommends the refund of $30,606.91 to Southern Pacific Transporation company.
