CITY OF COLTON <br />CLOSED SESSION — REGULAR COUNCIL/REDEVELOPMENT AGENCY/COLTON <br />UTILITY AUTHORITY CLOSED SESSION MEETING MINUTES <br />NOVEMBER 4, 2008 <br />Closed Session Meeting was held on the above given date at 5:00 p.m., in the Council <br />Chambers of City Hall, with Mayor Chastain presiding. <br />CITY COUNCIL ROLL CALL <br />Councilmembers present were, CM Suchil (arrived at 5:04 p.m.), Oliva, Yzaguirre, De La Rosa, <br />Toro, Mayor Pro Tempore Mitchell and Mayor Chastain. <br />PUBLIC COMMENT: <br />None. <br />City Attorney Derleth announced that the City Council would meet in Closed Session to discuss <br />items A. City Attorney Derleth announced that he would recuse himself from any discussion on <br />this item as his law firm represents the City of Rialto on other matters. <br />CLOSED SESSION: <br />A. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION <br />Pursuant to Government Code section 54956.9(a) <br />Case Name: City of Rialto v. City of Colton, et al. <br />Case Number: San Bernardino County Superior Court Case No. CIVSS 809613 <br />City Attorney adjourned the meeting to Closed Session at 5:02 p.m. and at 6:03 p.m.; the <br />meeting reconvened with all members present as heretofore. <br />City Attorney Derleth reported that the Council did meet and did confer in Closed Session on <br />the items previously announced with no reportable action on Item A. <br />A.
