R-17-09 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON AMENDING EXISTING ELECTRIC RATES AND CHARGES AND CREATING A NEW ELECTRIC RATE WHEREAS, the City Council has the authority to prescribe, revise and collect charges for the services and facilities furnished by the electric energy enterprise within the Colton Electric Utility ("Utility") and to otherwise amend, fix and/or establish the rates to be charged for the sale of electric energy, as well as all other deposits and charges in connection therewith (such charges are collectively referred to herein as "Rate" or "Rates"); and WHEREAS, the City Council has previously adopted electric Rates for customers in the City pursuant to Resolutions Nos. R-32-95 and R-02-06 and the exhibits attached thereto; and WHEREAS, by way of this Resolution, the City Council now desires to amend the Rates as set forth and described in Resolutions Nos. R-32-95 and R-02-06 and the exhibits thereto, to increase the rates and charges for most categories of electric customers; and WHEREAS, the revised rates adopted by this Resolution have been available for public review prior to the City Council meeting at which this Resolution has been considered. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council has considered an increase to the existing electric rates and charges at public meetings on February 17, 2009 and March 17, 2009, and City staff have conducted two public forums to afford members of the public the opportunity to discuss the proposed rate increases and express their views concerning the rate increases. SECTION 2. The City hereby determines that: (a) the proposed new rates and charges are not discriminatory or excessive; (b) the proposed new rates and charges will be sufficient to pay any amounts required under any bonded indebtedness; (c) the proposed new rates and charges will be sufficient under the provisions or covenants of any outstanding revenue bonds of the City payable from the revenues of the electric energy enterprise; and (d) the proposed new rates and charges will be in compliance with applicable law. SECTION 3. The City hereby adopts, by way of this Resolution, the attached new rates and charges to be charged to various existing and new customers for the services and facilities furnished by the electric energy enterprise within the Utility, as set forth in the attached Exhibit "A" (New and Amended Electric Energy Rates and Charges for the Colton Electric Utility), which is incorporated herein by reference.
