R-22-18 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA, UPDATING FEE FOR APPEAL OF <br />PLANNING COMMISSION AND DIRECTOR'S DECISION <br />WHEREAS, on April 19, 2016, the City Council adopted Resolution No. R-30-16, <br />which updated and adopted certain new Planning and Building user fees, including the fee for <br />appealing a decision of the Planning Commission or Development Services Director; and <br />WHEREAS, the City has conducted a nexus analysis of the Appeal fee to ensure that <br />said fee accurately reflects the cost of performing services required in response to the filing <br />of an Appeal; and <br />WHEREAS, with exception of the Appeal fee, all other portions of Resolution No. R- <br />30-16 shall remain unchanged after adoption of this Resolution; and <br />WHEREAS, a properly noticed public hearing was conducted on March 6, 2018 to <br />receive public comments on the proposed change to the Development Services scheduled of <br />fees and charges. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Colton does hereby find, determine and declare as follows: <br />SECTION 1. Adoption of Fee. The fee for an Appeal of Planning Commission or <br />Director's decision is hereby established at $700.00 (flat fee), plus the fee in effect at the time <br />of appeal filing for publication of a public hearing notice. <br />SECTION 2. Supporting Evidence & Study. The adoption of this Resolution is <br />based on all oral and written evidence prepared by and/or presented to the City, including but <br />not limited to, the Fee Nexus Analysis, prepared by the City with input from all affected <br />parties. This study, which documents that the revised Appeal fee does not exceed the cost to <br />the City of providing noted services, is hereby accepted by the City Council. <br />SECTION 3. CEQA Findings. The City Council hereby finds that, in accordance <br />with the California Environmental Quality Act ("CEQA") and the CEQA Guidelines, the <br />adoption of this Resolution is exempt from CEQA pursuant to Section 15061(b)(3). <br />// <br />// <br />// <br />// <br />
