R-21-13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, DECLARING ITS INTENTION TO SET A PUBLIC HEARING FOR MUNICIPAL SOLID WASTE AND DISPOSAL SERVICE RATES FOR FISCAL YEAR 2013/2014. WHEREAS, the City of Colton is a municipal corporation duly organized and existing pursuant to the Constitution and laws of the State of California ("City"); WHEREAS, the City Council has by previous action entered into a service agreement with Republic Services for the collection and disposal of residential and commercial waste within the City of Colton. WHEREAS, annual rates are adjusted to include any increases to the local CPI and San Bernardino County disposal fees. WHEREAS, the service rates for fiscal year 2013/2014 have been included as Exhibit A to this Resolution. NOW, THEREFORE BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CITY COUNCIL, AS FOLLOWS: 1. The above recitals are true and correct. 2. Intention: The City Council hereby declares its intention to provide and collect fees for solid waste collection services provided to all property owners within the City, described in Section 3 of this Resolution, for Fiscal Year 2013/2014. 3. Description of Services: The improvements within the District include but are not limited to: trash collection, trash disposal, yard waste collection and processing, recycle collection and processing, and bulky -item collection. 4. Public Hearing: The City Council hereby declares its intention to conduct a Public Hearing concerning the fiscal year 2013/2014 solid waste collection rates. The public hearing will be held not less than forty-five (45) days after the City mails notice of the public hearing as provided for in (5) below. 5. Mailed Notice: The City will provide written notice by mail of the proposed fee to the recorded owner of each identified parcel upon which the fee is to be imposed. The notice will contain all of the following information: (A) the amount of the proposed fee; (B) the basis on which the amount of the proposed fee or charge was calculated; (C) the reason for the fee or charge; and (D) the date, time and location of a public hearing on the proposed fee or charge. The notice shall also be mailed at least 14 days in advance of the hearing to any interested party who has a written request for notification on file with the City.
