1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-05-11 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON <br />TO AMEND TITLE 18, CHAPTER 18.50 OF THE COLTON <br />MUNICIPAL CODE RELATING TO TEMPORARY PROMOTIONAL <br />SIGNS (FILE INDEX NO.: DAP -000-926A) <br />WHEREAS, the Planning Commission of the City of Colton ("Planning Commission") <br />initiated an application to amend Chapter 18.50 of Title 18 of the Colton Municipal Code ("Sign <br />Ordinance"), as allowed by Section 18.58.050.A.2. of the Colton Municipal Code, to clarify and <br />update existing code sections related to signs; and <br />WHEREAS, the Planning Commission conducted study sessions on January 25, 2011, <br />June 28, 2011, and July 12, 2011 to discuss and solicit testimony to reevaluate the type of <br />promotional signs that the City of Colton ("City") should permit and to allow additional signage <br />opportunities for businesses; and <br />WHEREAS, on August 9, 2011, the Planning Commission held a duly noticed public <br />hearing regarding an ordinance to amend the Sign Ordinance (the "Ordinance") to maximize <br />additional promotional signage opportunities for City businesses; and <br />WHEREAS, the City Council wishes to adopt the Ordinance to maximize additional <br />promotional signage opportunities for City businesses; and <br />WHEREAS, banners placed on the upper portion of City -owned utility poles are an <br />important medium for providing notice to City residents, as well as those who work in and visit <br />the City, about special events that are sponsored by the City; and <br />WHEREAS, because of the economic benefits that the City gains from tourism, and the <br />benefits derived from community awareness of and participation in community events, the City <br />has a strong interest in fostering tourism and civic pride by promoting City -sponsored special <br />events; and <br />WHEREAS, by amending the Sign Ordinance to allow banners placed on City -owned <br />utility poles, the City Council does not intend to create a public forum on the upper portion of <br />said poles, and has decided to make the upper portion of City -owned utility poles available for the <br />installation of banners that announce City -sponsored special events in order to achieve its goals of <br />promoting tourism and civic pride; and <br />WHEREAS, the City Council wishes to adopt the Ordinance to allow the placement of <br />banners on City -owned utility poles in the public right-of-way; and <br />WHEREAS, on October 4, 2011, the City Council of the City of Colton ("City Council') <br />held a duly noticed public hearing at which time all persons wishing to testify in connection with <br />the Ordinance were heard and the Ordinance was comprehensively reviewed; and <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred. <br />23152.06300\6941313.1 <br />
