1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 0-06-11 AN UNCODIFIED ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON ADOPTING YEAR-ROUND PROMOTIONAL SIGN REGULATIONS (FILE INDEX NO.: DAP -000-926B) WHEREAS, the Planning Commission of the City of Colton ("Planning Commission") initiated an application to amend Chapter 18.50 of Title 18 of the Colton Municipal Code ("Sign Ordinance"), as allowed by Section 18.58.050.A.2. of the Colton Municipal Code, to clarify and update existing code sections related to signs; and WHEREAS, the Planning Commission conducted study sessions on January 25, 2011, June 28, 2011, and July 12, 2011 to discuss and solicit testimony to reevaluate the type of promotional signs that the City of Colton ("City") should permit and to allow additional signage opportunities for businesses; and WHEREAS, on August 9, 2011, the Planning Commission held a duly noticed public hearing regarding the adoption of an uncodified year-round promotional sign ordinance ("Year - Round Promotional Sign Ordinance") to maximize additional promotional signage opportunities for City businesses on an interim basis; and WHEREAS, on October 4, 2011, the City Council of the City of Colton ("City Council') held a duly noticed public hearing at which time all persons wishing to testify in connection with the Year -Round Promotional Sign Ordinance were heard and the Ordinance was comprehensively reviewed; and WHEREAS, the City Council wishes to adopt the Year -Round Promotional Sign Ordinance to maximize additional promotional signage opportunities for City businesses on an interim basis; and WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: SECTION 1. Incorporation of Recitals. The City Council hereby adopts the recitals set forth above in connection with this Year -Round Promotional Sign Ordinance. SECTION 2. Maximum Signage. Each business or nonresidential use shall be allowed one (1) year-round promotional sign, subject to the requirements of this Year -Round Promotional Sign Ordinance. SECTION 3. Duration. All year-round promotional signs shall be removed one (1) year after the Effective Date of this Year -Round Promotional Sign Ordinance. SECTION 4. Permit. Subject to the requirements of this Ordinance, year-round promotional signs shall not require the approval of a sign permit pursuant to Section 18.50.040 of the Sign Ordinance. 23152.06300\6964570.1
