R-09-01 <br />RESOLUTION OF THE CITY OF COLTON, CALIFORNIA, <br />APPROVING A SIGN OPERATION PROGRAM AGREEMENT BY <br />AND BETWEEN GIANT INLAND EMPIRE RV CENTER, INC. AND <br />THE CITY OF COLTON. <br />WHEREAS, the City of Colton, California (the "City") is a municipal corporation duly <br />created and existing pursuant to the Constitution and the laws of the State of California; and <br />WHEREAS, the City wishes to support and encourage economic development and <br />business development in the community, including the creation of new job opportunities; and <br />WHEREAS, the City of Colton entered into that enter into that certain Agreement for <br />Purchase of Operating Covenant and Operating Covenant dated August 17, 1999 (the <br />"Covenant Agreement") with Giant Inland Empire RV Center, Inc., a California corporation <br />(the "Developer") regarding the construction of construction of a RV Dealership facility ("New <br />Dealership"), consisting of a 9,256 square foot two-story sales office and a 23,155 square foot <br />parts and service facility and the possible construction of an Electronic Readerboard Sign ( the <br />"Sign") all on approximately 11 acres, on property owned by the Developer, generally on Santo <br />Antonio Drive in the City of Colton (the "Property"); and <br />WHEREAS, the Covenant Agreement provided that if the Sign was constructed <br />the Developer would grant a Sign Easement to the City of Colton whereby the City would have <br />the right to use the Sign for City business twelve (12) minutes of every hour the Sign is in <br />operation; and <br />WHEREAS, the Covenant Agreement provided that the City and Developer <br />would adopt and approve a Sign Operations Program which would establish certain rules and <br />procedures regarding the City's use of the Sign; <br />operational. <br />WHEREAS, the Sign has been constructed by the Developer and is now <br />
