1 RESOLUTION NO. R-106-02 <br />2 A RESOLUTION OF THE COLTON UTILITY AUTHORITY OF THE CITY OF <br />COLTON RATIFYING THE CITY MANAGER'S DECLARATION OF AN <br />3 EMERGENCY AND THE ACTIONS HE DEEMED NECESSARY TO REPAIR <br />WELL NO. 7 <br />4 WHEREAS, Section 22050 of the State Public Contract Code governs emergency <br />5 <br />contracting procedures applicable to the City of Colton; and <br />6 <br />7 WHEREAS, Section 22050 of the Public Contract Code allows the Colton Utility' <br />8 Authority to pass a resolution by a four-fifths vote of its membership declaring that (a) <br />9 emergency conditions that exist that do not permit a delay resulting from a competitive <br />10 solicitation for bids; and (b) the repairs are necessary to respond to the emergency; and <br />11 WHEREAS, the Colton Utility Authority finds, based upon the Staff Report and other <br />12 <br />information in the record, that emergency conditions existed at Well #7, which meet the <br />13 <br />requirements of Section 22050, and that the City Manager took appropriate action to respond <br />14 <br />to such emergency. <br />15 <br />16 NOW, THEREFORE, BE IT RESOLVED that the Colton Utility Authority resolves as <br />follows: <br />17 1. The City Council hereby ratifies the City Manager's actions to order materials and <br />labor, in an amount not -to -exceed $16,867.84, to replace the pump at Well No. 7, pursuant to <br />1s Section 22050 of the Public Contract Code, to respond to the stated emergency. <br />19 <br />PASSED, APPROVED and ADOPTED this 3 day of September 2002. <br />20 <br />21 <br />22 DEIRDRE H.
