ITEM #6 <br />CITY OF COLTON <br />For the City Council Meeting of <br />June 5, 2007 <br />TO: Honorable Mayor and Councilmembers <br />FROM: Candace Cassel, Economic Development Directork`� <br />SUBJECT: Consideration and Approval of an Ordinance Adopting <br />Policies Regarding Use of Eminent Domain in Downtown No. <br />1 & 2, Cooley Ranch, Santa Ana River, Rancho Mill, Mt. <br />Vernon Project, West Valley, and West Valley Amendment <br />Project Areas <br />DATE: May 4, 2007 <br />BACKGROUND/DISCUSSION <br />California Senate Bill 53 ("SB 53"), which went into effect on January 1, 2007, adds <br />requirements for new and existing redevelopment plans that contain authority to use eminent <br />domain. <br />SB 53 requires that the legislative body adopt an ordinance on or before July 1, 2007, <br />describing the agency's program to acquire real property by eminent domain in its <br />redevelopment project areas, even where such power has expired. Once the agency adopts <br />the required ordinance, the agency can only change its eminent domain program by amending <br />its redevelopment plan. These changes do not affect the substantive power of eminent domain. <br />The ability to exercise the power of eminent domain has expired in each of the redevelopment <br />project areas in the City of Colton, as noted in the chart below: <br />FINANCIAL IMPACT <br />Adoption of the Ordinance will not impact the agency budget or the City budget. <br />Cooley <br />Downtown <br />Downtown <br />Mt.
