ITEM #6 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE CITY COUNCIL MEETING OF FEBRUARY 3, 2009 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: MARITZA TAPIA, INTERIM PUBLIC WORKS DIRECTOR <br />SUBJECT: AUTHORIZE AWARD OF A PROFESSIONAL SERVICES <br />AGREEMENT TO TECHNICAL SERVICES UNLIMITED IN THE <br />AMOUNT OF $100,000. <br />DATE: January 27, 2009 <br />BACKGROUND: <br />The current vacancy of the Public Works Director/City Engineer position has left the Engineering <br />Division of the Public Works Department without a licensed engineer in-house. In February <br />2008, Council action identified the principal for Technical Services Unlimited, Thomas I. <br />Williams, as the Interim City Engineer/Construction Manager. The Public Works Department <br />requires a licensed engineer to continue to temporarily undertake the basic functions of a City <br />Engineer. The existing contract with Technical Services Unlimited expired on January 31, 2009. <br />The following functions previously executed by the City Engineer are currently unavailable to <br />department staff in-house: <br />Sign city plans and specifications for capital improvement projects and proposed <br />development projects <br />Act as a resource for Engineering staff, City staff and other organizations, coordinate <br />pertinent information, resources and work teams necessary to support a positive and <br />productive environment. <br />Attend and participate in professional community meetings as necessary; stay current on <br />issues relative to the field of Engineering and relative service delivery responsibilities; <br />respond to and resolve sensitive and complex community and organizational. <br />ANALYSIS/DISCUSSION: <br />Many ongoing projects are in the construction phase and will require construction management. <br />Section 3.08.140 (E) of the CMC authorizes the Council to waive the formal proposal process for <br />professional services agreements when the City Manager determines that it is in the best interest of <br />the City and its Administrative operations to dispense with public bidding. As the City Engineer <br />position remains unfilled at this time it is prudent to retain consistency within the Engineering <br />Division to ensure project schedules are not affected by changing factors. Staff requests a new <br />agreement be awarded to Technical Services Unlimited for City Engineer and construction <br />management services. The proposed agreement will have an eleven month term, February 1, <br />2009 through December 31, 2009, and not exceed $100,000. As the Interim City Engineer Mr. <br />Williams will report to the Interim Public Works Director and work collaboratively with the <br />Engineering Manager on all assigned projects. <br />
