CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF MAY 5, 2009 <br />TO: Honorable Mayor and City Council <br />FROM: Jeannette Olko, Electric Utility General Manager <br />ITEM #7 <br />SUBJECT: Approve The Fifth Amendment to Professional Services Agreement with <br />AECOM, Inc., dba AECOM Environment, Extending the Term of the <br />Agreement Through June 30, 2010, and Increasing the Total Compensation <br />by an Additional Amount Not -To -Exceed $20,000.00. <br />DATE: April 27, 2009 <br />BACKGROUND: <br />In 1996, the Drews Substation and transmission lines were constructed to serve the Arrowhead Regional <br />Medical Center and surrounding load. As part of the US Fish and Wildlife Service (USFWS) mitigation <br />plan, the City entered into a Habitat Conservation Plan and Implementation Agreement. ENSR, an <br />environmental consulting firm, has been providing consulting and compliance reporting services for the <br />Electric Department to the USFWS with regards to the 7.5 acres set aside for Delhi Sands Flower -Loving <br />Fly habitat. <br />DISCUSSION/ANALYSIS: <br />Per the City's agreement with USFWS, the City is required to continue to monitor, implement, and report <br />on the habitat conservation plan related to site conditions and assure that the habitat is conserved per <br />USFWS requirements. ENSR has expertise in this field and has been providing this professional service <br />to the Electric Department since 1996. The existing contract expires June 30, 2009. As the City is still in <br />negotiations with the USFWS it is necessary to extend the Agreement for another one year period, <br />through June 30, 2010 and to increase the total compensation by an additional $20,000.00. In addition, <br />ENSR notified the City in February 2009, that it had changed its corporate name to AECOM, Inc., dba <br />AECOM Environment. <br />AECOM is familiar with the City's habitat area and the contract with USFWS. They have continued to <br />provide excellent services in helping the City to meet contract obligations established with USFWS. <br />During the one-year extension period, the Electric Department, in conjunction with the City Manager's <br />office, will look for alternatives for continued reporting on the mitigation site. <br />FINANCIAL IMPACT: <br />Funds will be included in the Electric Utility Administration Professional Services Account Number 520- <br />8000-8001-2350-0923-000 for FY 09/10. <br />Budget <br />Year -to -Date <br />Open Encumbrances <br />Available Funds <br />Expenditures <br />Will be included in <br />FY 09/10 <br />FY09/10 Budget <br />ENVIRONMENTAL IMPACT: <br />None <br />
