0 <br />AGENDA REPORT <br />CITY OF COLTON <br />For City Council Meeting of <br />August 5, 1997 <br />July 23, 1997 <br />TO: MAYOR GAYTAN, CITY COUNCIL AND CITY MANAGER <br />FROM: Julie Hayward Biggs, City Attor ey <br />SUBJECT: Ballot Measure/City Manager Ordin nee <br />As requested by Councilmember Sanders, attached is a copy of the proposed City <br />Manager ordinance to be submitted to the electorate at the November 1997 election, together <br />with a copy of our current ordinance. While numerous changes have been made to the <br />ordinance throughout to conform our ordinance to current law and constitutional requirements, <br />the most significant changes are as follows: <br />1. The office of city manager has been clearly identified as an "at will" <br />position and that anyone appointed to that position serves at the pleasure of the City <br />Council, subject to the limitations of law relating to such employment. <br />2. The ordinance specifies that the City Council may enter into a contract <br />with its appointee for the position of City Manager. Under the current ordinance, no <br />contract is permitted. Instead, appointment is by resolution. A contract arrangement <br />allows the City greater flexibility in setting the terms and conditions of employment and <br />of termination. <br />3. The requirement for residence in the City of Colton has been eliminated <br />in accord with applicable law. <br />4. Councilmembers remain ineligible to serve as City Manager for one year <br />after leaving office. <br />5. Compensation for the City Manager may be set either by resolution or by <br />contract. Currently, it must be set by resolution. <br />6. Reimbursement for expenses remains a matter for Council approval as is <br />currently the requirement. <br />Item No. 24 <br />
