Wheaton. <br />'DATE: December 9, 1997 <br />BACKGROUND: On August 8, 1997, Firefighter Specialist Wheaton was declared permanent and <br />stationary by Orthopedic Surgeon John Steinmann, D.O. Primary disabling condition is lumbar disc <br />herniation (back injury). Based on Dr. Steinmann's report, Firefighter Specialist Wheaton will be unable to <br />return to his duties as a Firefighter Specialist and restricted from heavy lifting, repeated bending and <br />stooping. <br />DISCUSSION/ANALYSIS: Firefighter Specialist Wheaton applied for industrial disability retirement <br />with the California Public Employees' Retirement Systems (Ca1PERS). Under PERS law, the City <br />Council or its designee makes the determination as to when a safety employee is disabled and if the injury <br />is industrial. <br />FINANCIAL IMPACT: Advanced Disability Pension payments will be made in the amount of $1,317 <br />per month until retirement benefits are directly received from Ca1PERS. The first payment for the period <br />December 15, 1997 through December 31, 1997 will be $722. CalPERS will reimburse the City for these <br />payments. <br />Thomas T.
