CITY OF COLTON <br />AGENDA REPORT IV <br />ri <br />FOR COUNCIL MEETING OF FEBRUARY , 1997 <br />TO: Honorable Mayor and City Council <br />APPROVAL: M ik Fr eman, City na <br />FROM: Da i Zamora <br />Community Devel Director <br />SUBJECT: Amendment to Colton Municipal Code Repealing and Amending <br />Certain Provisions Pertaining to Business Licenses, File Index <br />Number DO -03-97 <br />DATE: <br />29, 1997 <br />BACKGROUND: <br />The City of Colton Community Development Department was requested to initiate an <br />amendment to the business license regulations set forth in the City's Municipal Code at <br />Chapter 5.02. On January 28, 1997, the Planning Commission considered File Index <br />Number DO -03-97, a proposed ordinance to repeal in its entirety subdivision F of section <br />5.02.040, which permits the City's Collector, as that term is defined in section 5.02.020, to <br />require additional unspecified information on the business license application and to <br />resdesignate subdivision G of section 5.02.040 as subdivision F. <br />After consideration of all the evidence presented, including staff comments and the proposed <br />ordinance, the Commission adopted the attached Resolution, Number R-02-97, a <br />recommendation to the City Council to adopt the proposed ordinance repealing and <br />amending certain sections of the Colton MunicipalCode pertaining to business licenses. <br />DISCUSSION/ANALYSIS: <br />Subdivision F of section 5.02.040 currently provides that an applicant for a business license <br />may be required, in addition to the information specifically enumerated, to provide "[f]urther <br />information which the collector may reasonably require to enable him to issue the type of <br />license applied for." Staff feels that this provision should be deleted to conform to recent <br />case law decisions governing approvals of such licenses. <br />Attached to this report is a copy of the materials provided to the Planning Commission at <br />their public hearing of January 28, 1997, at which the Commission made its recommendation <br />to the City Council. The staff report of the Planning Commission constitutes the analysis for <br />this staff report. <br />
