TO AWARD TOWING FRANCHISES TO <br />SOUTH STATE TOWING AND EXCLUSIVE TOWING <br />DATE: JANUARY 11, 1999 <br />Background: On September 1, 1998, the City Council adopted Resolution No. R-83-98 setting forth <br />the adopting criteria for granting tow truck franchises in accordance with Ordinance No. 0-18-98. <br />Upon City Council direction and in accordance with the provisions of Chapter 10.40.050 of the <br />Colton Municipal Code, staff published a Request for Qualifications in order to fill vacancies for two <br />towing franchises on the police department's current tow roster. At the conclusion of the Request <br />for Qualifications, the Purchasing Coordinator took the information provided by the responsive tow <br />agencies, evaluated it against the criteria in the ordinance, and gave a numerical score at the bottom <br />of the evaluation sheet with the total number of points. A total of seven (7) tow agencies responded <br />to the Request for Qualifications. South State Towing scored the most points with 44, and Exclusive' <br />Towing scored the second highest number of points with 43. Subsequent interviews were conducted <br />b notice Department <br />ep shatstaff with ter 10:40.656," <br />outh State Towing and Exclusive 'Vowing as provided in Colton <br />Chapter <br />Discussion: In accordance with the City's ordinance and resolution, South State Towing and <br />Exclusive Towing should be awarded the franchises. 'An issue was with respect to South States' <br />eligibility. However, staff recommends that the City Council address the issue by confirming that tow <br />operators registered with a California Highway Patrol ("CHP") office in San Bernardino County be <br />treated as registrants with a local CHP office. Colton Municipal Code Section 10.40.060, subsection <br />20, requires that a tow applicant be an approved CHP towing service for the Riverside/San <br />Bernardino area and shall have an operational agreement with the "local" CHP office. 'During <br />Administrative Lieutenant Frank Sullivan's interview with South State Towing, it was discovered that <br />South State Towing's area of approval for CHP -authorized tow was for the Rancho Cucamonga area. <br />South State Towing has verified that they do tow in San Bernardino County using the tow agreement <br />with the Rancho Cucamonga CHP office_ The City Attorney has advised staff that South State <br />RVPL'91CSD156082 <br />
