DELGADO, Human Resources Manager vt <br />SUBJECT: Request Determination of Disability Status for former Police Chief <br />Patrick Crowe, pursuant to Settlement Agreement <br />DATE: January 5, 2002 <br />Colton native, Patrick J. Crowe, served his community in the Police Department from November 20, 1971 until his <br />retirement as Police Chief on November 10, 2000. <br />ANALYSIS/DISCUSSION: <br />Initially, former Police Chief Crowe elected to leave under regular retirement but serious health problems led him to <br />submit a claim for disability retirement that was summarily denied. Following litigation, Police Chief Crowe and the <br />City of Colton agreed to enter into a settlement agreement with the caveat that the City of Colton, as a contracting <br />agency of the Public Employees' Retirement System, would determine the disability status of former Police Chief <br />Crowe and allow him to be awarded a disability retirement. <br />ENVIRONMENTAL IMPACT: <br />This item does not carry environmental impact. <br />FISCAL IMPACT: <br />There is no fiscal impact in this instance, as Ca1PERS will determine disability pension payments. <br />RECOMMENDATION: <br />Pursuant to settlement agreement, it is respectfully recommended that the members of the City Council approve and <br />adopt the proposed Resolution thereby determining the disability status of former Police Chief Patrick J.
