Item #2 1 ORDINANCE NO. 0-26-03 2 AN ORDINANCE OF THE CITY OF COLTON AMENDING 3 CHAPTER 5.02 OF THE COLTON MUNICIPAL CODE REGARDING BUSINESS LICENSE TAX 4 5 WHEREAS, The City Council of the City of Colton recognizes that the Colton 6 Municipal Code intends that the issuance of a business license must be for the sole purpose of 7 raising revenue and not for the purpose of regulation; and 8 WHEREAS, In 1975, the City Council adopted Ordinance No. 1471 which established 9 procedures for issuing business licenses; and 10 11 WHEREAS, since 1975, the increased number and types of businesses within the City have created the need to update and improve the City's procedures for issuing business 12 licenses; and 13 14 WHEREAS, the City Council established business license amounts in 1975 with the 15 adoption of Ordinance No. 1471 and later amended those amounts in 1992 with the adoption of Resolution No. R-73-92; and 16 17 WHEREAS, it in the best interest of the City of Colton to maintain consistency 18 between the intent of the Colton Municipal Code and the City's ordinances and resolutions by consolidating the language of Resolution No. R-73-92 with the Colton Municipal Code in order to 19 have one uniform document setting the amounts charged by the City for business licenses; and 20 21 WHEREAS, passage of this Ordinance will consolidate the resolution language with 22 the Colton Municipal Code without increasing or adjusting in any way the amounts charged for business licenses as previously set by Resolution No. R-73-92; and 23 24 WHEREAS, the City Council also desires to amend other existing provisions of the 25 Colton Municipal Code in order to improve the City's process for issuing business licenses, 26 including: (1) revising the appeals process to allow the City Manager to be the hearing authority, while ensuring an individual's right to appeal to the City Council; (2) ensuring that subcontractors 27 doing business within the City are obtaining City business licenses; (3) removing language 28 inconsistent with current provisions of the Colton Municipal Code and the California Revenue and RVPUB/NGS/661186 1
