RESOLUTION NO. 3581 <br />l <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />DECLARING WEEDS GROWING UPON THE.STREETS DR SIDEWALKS <br />2 <br />OR UPON PRIVATE PROPERTY AND RUBBISH, REFUSE OR DIRT <br />UPON PARKWAYS, SIDEWALKS OR PRIVATE PROPERTY WITHIN THE <br />3 <br />CITY OF COLTON TO BE A PUBLIC NUISANCE AND PROVIDING FOR, <br />THE ABATEMENT THEREFOR IN ACCORDANCE WITH SECTIONS 39501,. <br />4 <br />39561, 39561.5,'39562,. 39563, 39567,1, ALSO 39568-39586 <br />CHAPTER 13, ARTICLE 3, TITLE 4`, DIVISION 3 OF THE GOVERN - <br />5 <br />MENT CODE OF THE 'STATE OF CALIFORNIA. <br />.6 <br />WHEREAS, the City Council of the City of Colton has beeninformed <br />7 <br />that there are growing upon the streets and sidewalks and private property <br />within said City many weeds which have seeds of a wingy or downy nature or <br />9 <br />have attained such growth as to:beccme a fire menace or which are,'otherwise <br />10 <br />noxious or ;dangerous and there is also existing on c'e'rtain parkways, sidewalks <br />11 <br />and property within the City certain rubbish, refuse and dirt including dry <br />12 <br />grass, stubble, brush, litter or other flammable material which endangers the <br />5 <br />13 <br />public safety by creating a fire hazard, and <br />14 <br />WHEREAS, the City Council is of the opinion that same should be <br />15 <br />'declared a public nuisance and should be abated in accordance with provisions r. <br />. 16 <br />of the Weed Abatement Law (Chapter 13, Title 4, Division 3, Government Code <br />1.7 <br />and amendments thereto) of the State of California, and <br />18 <br />WHEREAS,.the Street Superintendent has prepared a report properly <br />19 <br />describing the property upon which the condition exists, <br />20 <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the Cit y <br />21 <br />of Colton as follows: <br />22 <br />1, That the_City"Council does hereby ,find, determine and declare <br />23 <br />that there are growing -upon the streets and sidewalks and private property <br />24 <br />within saidcitymany weeds which have seeds of a downy nature or have attained <br />25 <br />such growth as to become a fire menace or which are otherwise noxious or <br />26 <br />dangerous and that there is also existing on certain parkways, sidewalks, <br />27 <br />and property within the City certain rubbish, refuse and dirt including dry. <br />28 <br />grass, stubble, brush, litter or otherwise flammable material which endangers <br />29 <br />the public safety by creating a fire hazard. <br />30 <br />2. That the commonly known names of the streets and the descrip- <br />31 <br />tion of the property upon which or in front of which said weeds and/or rubbish, <br />32 <br />
