Aguilera, Director of Community Development G <br />SUBJECT: Time extension for zone change File Numbers D-73-88 and A-4-88 <br />E <br />The City Council has previously set this item for public hearing and has continued the N <br />item to this date. The applicant received conditional approval of a zone change on Sep- <br />tember 13, 1988. The conditions under which the applicant was allowed to change his <br />property's zoning from R-3 to C-2 state: "If the applicant fails to perform and complete <br />the conditions as required within one year, the zoning granted shall revert to its original D <br />zoning". <br />A one year extension has already been granted to the applicant to September 13,1989, <br />then again to September 13, 1990. The applicant is now requesting an additional time <br />extension of one year which would then allow the project to expire on September 13, <br />1991. <br />ANALYSIS <br />As the Council may see by the attached Council Ordinance Number 0-30-88, there are R <br />ten conditions of approval, of which conditions numbers 3, 5, 6, and 8 are of uupmost <br />importance to the City, given the Plaza Las Flores development and the 5 Points Shop- <br />ping Center which is expected to break ground soon.
