CITY OF COLTON <br />AGENDA REPORT <br />For Council Meeting of April 7, 1992 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: GORDON R. JOHNSON, PERSONNEL DIRECTOR 'Date: 3-11-92 <br />SUBJECT: APPROVAL FOR WORKERS' COMPENSATION BENE ITS FOR CITY <br />VOLUNTEERS <br />BACKGROUND: Currently, California Workers' Compensation law does not <br />require that public agencies recognize volunteers as employees for <br />the purpose of providing workers' compensation benefits. However, <br />Labor Code 3363.5 states that public agency volunteers can be <br />declared employees upon adoption of a resolution, thus, being <br />eligible for workers' compensation benefits. <br />ANALYSIS: By including volunteers as employees, workers' <br />compensation becomes the "sole remedy" for recovering damages in the <br />event of an injury (in most cases), and it limits the volunteer's <br />access for retribution in civil court. Although, it would seem <br />logical to purchase a separate policy for volunteer medical coverage, <br />workers' compensation coverage is the preferred choice in contrast to <br />having the volunteer worker file a civil lawsuit which could be very <br />expensive to the City. <br />RECOMMENDATION: That the City Council adopt a resolution naming <br />volunteers as employees for the purpose of providing workers' <br />compensation benefits. <br />Concur <br />City Manager <br />D8:AGNAPP <br />
