Drews, Electric Utility Director <br />SUBJECT: APPROVAL AND ACCEPTANCE OF AGREEMENT FOR Date: 8/6/92 <br />UTILITY EASEMENT ON REAL PROPERTY IN EXCHANGE <br />FOR CITY FACILITATING RELOCATION OF THE COOLEY HOUSE <br />BACKGROUND <br />Gary Jackson, Lynne Jackson, Jack Rosenbaum, and Barbara Rosenbaum (the <br />"Grantors") would like to relocate the Cooley House. The City is willing, at its <br />expense, to facilitate the relocation of the Cooley House by removing and <br />reinstalling the existing electrical wires and streetlight wires owned by the <br />City and located on City streets, such that the Cooley House may be moved in <br />exchange for an Easement for electrical purposes over and across that portion of <br />the South half of the Northeast quarter of Section 3 Township 2 South range 4 <br />West S.B.M. <br />ALTERNATIVES <br />This Agreement arose out of City's efforts to acquire the Easement through its <br />eminent domain authority. Rather than proceed with the condemnation process, <br />Grantors have agreed to accept the offer of City contained in this Agreement. <br />FINANCIAL IMPACT <br />The Electric Department had planned to remove and reinstall guy wires and <br />streetlight wire for the relocation of the house at a cost of $1,212.00. This <br />cost would now be absorbed with this Agreement providing full payment for the <br />acquisition of the Easement on the Property. <br />ENVIRONMENTAL IMPACT <br />N/A <br />RECOMMENDATION <br />It is Staff's recommendation that Council approve Mayor Gonzales sign the <br />Agreement as written. <br />The Agreement is on file in the City Clerk's office for your review. <br />City Manager's Concurrence:- <br />Mark Lewis <br />Attachments: <br />Page 1 of 1 Item No. <br />
