AGENDA REPORT CITY OF COLTON For City Council Meeting of June 211 1994 May 31. 1994 TO: HONORABLE MAYOR AND CITY COUNCIL FROM: Julie Hayward Biggs, City Attorn SUBJECT: Revision of Purchasing Ordinance BACKGROUND Councilmember Beltran has requested that the City Council consider amendment of the City's purchasing ordinance (Colton Municipal Code Chapter 3.08) regarding the provisions of Section 3.08.150. That section authorizes the City Manager to award contracts for professional services for approved budget items in amounts up to $100,000 without the approval of the City Council. In addition, so long as funds are generally available in the budget, the City Manager is authorized to award contracts for professional services in amounts up to $50,000 without the approval of the City Council. Only those contracts for professional services in excess of $100,000 are required to be approved by the City Council. Section 3.08.150 sets forth the process for awarding such processional services contracts, including a requirement that contracts in excess of $50,000 be awarded based upon requests for proposal. The City Council has the authority to waive the request for proposal requirement "if it finds that the public interest will not best be served by a formal proposal process." The contract for construction of the Colton Community Center was approved by the Council under that provision of the Municipal Code. The City. Manager is authorized to award contracts for professional services which are not anticipated to exceed $50,000 without a formal request for proposal process. Contracts which are anticipated to exceed $10,000, however, must be based upon a written proposal including the scope of service and a fee schedule. The City Manager is required to provide the City Council on a quarterly basis a summary of all contracts which have been let that exceed $10,000. RECOMMENDATION The Council should direct staff if it wishes to change the provisions of the purchasing ordinance with regard to professional services contracts and the authorization it wishes to grant to the City Manager to act without prior Council approval to award such Item No. 31
