CITY OF COLTON <br />CLOSED SESSION — REGULAR COUNCIL/REDEVELOPMENT AGENCY/COLTON <br />UTILITY AUTHORITY CLOSED SESSION MEETING MINUTES <br />SEPTEMBER 16, 2008 <br />Closed Session Meeting was held on the above given date at 5:08 p.m., in the Council <br />Chambers of City Hall, with Mayor Pro Tempore Mitchell presiding. <br />CITY COUNCIL ROLL CALL <br />Councilmembers present were, CM Suchil, Oliva, Yzaguirre, Toro, Mayor Pro Tempore Mitchell. <br />ABSENT <br />CM De La Rosa and Mayor Chastain <br />PUBLIC COMMENT: <br />None. <br />City Attorney Derleth announced that the City Council would meet in Closed Session to discuss <br />items A and B. City Attorney Derleth will be recusing himself from both items due to a working <br />relationship with City of Rialto and Geralyn Skapik, will be acting as Special Counsel. <br />CLOSED SESSION: <br />A. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION <br />Pursuant to Government Code section 54956.9(a) <br />Case Name: City of Rialto v. City of Colton, et al. <br />Case Number: San Bernardino County Superior Court Case No. CIVSS809613 <br />(Settlement discussion) <br />B. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION <br />Pursuant to Government Code section 54956.9(a) <br />Case Name: City of Colton v. City of Rialto <br />Case Number: San Bernardino County Superior Court Case No. CIVSS811119 <br />(Formation of settlement committee) <br />Mayor Chastain adjourned the meeting to Closed Session at 5:09 p.m. and at 6:01 p.m.; the <br />meeting reconvened with all members present as heretofore. CM De La Rosa absent <br />City Attorney Derleth reported that the Council did meet and did confer in Closed Session on <br />the items previously announced with no reportable action on Item A and B. <br />A.
