CITY OF COLTON <br />COUNCIL/REDEVELOPMENT AGENCY/COLTON UTILITY AUTHORITY/COLTON PUBLIC <br />FINANCING AUTHORITY <br />SPECIAL MEETING MINUTES <br />MAY 10, 2010 <br />A Special Meeting of the City Council/Redevelopment Agency/Colton Utility Authority/Colton <br />Public Financing Authority of the City of Colton was held at 5:39 p.m., on the above -given date <br />at the City of Colton, Council Chambers, 650 N. La Cadena Drive, Colton, CA 92324 with Mayor <br />Chastain presiding. Notice of Special Meeting was given on May 6, 2010, in compliance with <br />Government Code Section 54956. <br />ROLL CALL <br />Council Members present were, De La Rosa, Yzaguirre, Oliva, Bennett, Perez, Mayor Pro <br />Tempore Toro and Mayor Chastain. Also present were City Manager Foster, City Clerk Gomez. <br />MAYOR AND COUNCIL ITEMS: <br />POSSIBLE CONFLICT OF INTEREST DISCLOSURES FOR THE COUNCIL MEETING OF <br />MAY 10, 2010. <br />Mayor Chastain asked the members present if there were any agenda items that were a conflict <br />of interest pursuant to CMC Section 2.04.030. None disclosed. <br />PUBLIC COMMENT: <br />The following citizens addressed the council: None <br />MAYOR AND COUNCIL ITEMS: <br />Said Special Meeting shall be for the purpose of studying and or taking action on the following <br />matters: <br />(1) Redevelopment Planning Services. <br />City Attorney Derleth announced that due to the conflict by Mayor Chastain, Council members <br />Oliva, De La Rosa, Yzaguirre and Bennett, the Rule of Necessity would be applied to tonight's <br />council meeting. He further explained that the "rule of necessity" allows an official to participate <br />in decisions where it is not possible to constitute a quorum out of officials who do not have <br />potential conflicts of interest and there are no alternative means of reaching a decision. A <br />random means of selecting the minimum number of Council members needed to participate in <br />the decision must be used to select the "conflicted" Council members who will participate. <br />Typically the City Clerk is asked to have the Council members select slips of paper marked <br />secretly in some way to indicate who will be allowed to participate. The process that will be <br />used will consist of the drawing of pieces of paper from a bowl that will be passed around by the <br />City Clerk. A total of five pieces of paper will be placed in a bowl with two pieces marked by <br />stars. Those Council members that pull/draw the papers marked with a star will be the two who <br />will remain at the dais, in order to vote on the item requiring the quorum. <br />City Attorney Derleth explained that the item on the agenda was regarding the proposed <br />amendment merger of seven project areas, five of the seven council members either own or <br />have an interest in properties within 500 feet of any of the projects, and in accordance with the <br />FPPC there is a potential Conflict of Interest whenever an elected official owns property within <br />2010 MAY 10 SPC CC/RDA/CUA MEETING - 1 - <br />
