R-21-13 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, DECLARING ITS INTENTION TO SET A PUBLIC HEARING FOR <br />MUNICIPAL SOLID WASTE AND DISPOSAL SERVICE RATES FOR FISCAL <br />YEAR 2013/2014. <br />WHEREAS, the City of Colton is a municipal corporation duly organized and existing <br />pursuant to the Constitution and laws of the State of California ("City"); <br />WHEREAS, the City Council has by previous action entered into a service agreement <br />with Republic Services for the collection and disposal of residential and commercial waste <br />within the City of Colton. <br />WHEREAS, annual rates are adjusted to include any increases to the local CPI and San <br />Bernardino County disposal fees. <br />WHEREAS, the service rates for fiscal year 2013/2014 have been included as Exhibit <br />A to this Resolution. <br />NOW, THEREFORE BE IT RESOLVED, DETERMINED, AND ORDERED BY THE <br />CITY COUNCIL, AS FOLLOWS: <br />1. The above recitals are true and correct. <br />2. Intention: The City Council hereby declares its intention to provide and collect fees for <br />solid waste collection services provided to all property owners within the City, described in <br />Section 3 of this Resolution, for Fiscal Year 2013/2014. <br />3. Description of Services: The improvements within the District include but are not <br />limited to: trash collection, trash disposal, yard waste collection and processing, recycle <br />collection and processing, and bulky -item collection. <br />4. Public Hearing: The City Council hereby declares its intention to conduct a Public <br />Hearing concerning the fiscal year 2013/2014 solid waste collection rates. The public hearing <br />will be held not less than forty-five (45) days after the City mails notice of the public hearing <br />as provided for in (5) below. <br />5. Mailed Notice: The City will provide written notice by mail of the proposed fee to the <br />recorded owner of each identified parcel upon which the fee is to be imposed. The notice will <br />contain all of the following information: (A) the amount of the proposed fee; (B) the basis on <br />which the amount of the proposed fee or charge was calculated; (C) the reason for the fee or <br />charge; and (D) the date, time and location of a public hearing on the proposed fee or charge. <br />The notice shall also be mailed at least 14 days in advance of the hearing to any interested <br />party who has a written request for notification on file with the City. <br />
