R-42-15. <br />(9) Update for Coburn Street Sewer Line Collapse Repair — Authorize the Lifting of Declaration of <br />Emergency for the Coburn Street Sewer Line Repair. <br />PUBLIC HEARING <br />(10) Habitat Mitigation Fee for Implementation of West Valley Habitat Conservation Plan <br />TIME AND PLACE FIXED TO CONSIDER AN ORDINANCE ESTABLISHING THE HABITAT <br />MITIGATION FEE PROGRAM AND ADOPTION OF RESOLUTION ADOPTING MITIGATION <br />FEE NEXUS STUDY AND HABITAT MITIGATION FEES. <br />Mayor DeLaRosa declared the Public Hearing Open. <br />City Clerk Padilla submitted the Affidavit of Publication calling the Public Hearing (onfile in the City Clerk's Office) <br />and there were no reports of protests or objections thereto. <br />Staff Presentation <br />Mark Tomich, Development Services Director, presented a PowerPoint presentation for Council discussion and <br />determination and concluded requesting approval of staff's recommendation. <br />Public Comment <br />The following community member addressed the Council: T. Robert Roy; Howard Wells; and Lori Pierson <br />Cripe; each have an interest as property owners who share with the City of Colton the Habitat Mitigation Fee <br />for the West Valley HCP and each requested the fee be waived. <br />Motion and Second by CM Jorrin/CM Gonzalez to close the Public Hearing. <br />Vote: All answered `Aye'. Unanimous. <br />Council Discussion <br />Discussion between Councilmembers and clarification by staff as it related to the comments stated during <br />Public Comment. A detailed explanation was provided by Director Tomich. Property owners were also referred <br />to their designated District Representative, Councilmember Toro, who will meet with them to further explain <br />the continued concerns. Reference was made as to how the Fish and Wild Life can interact with the property <br />owners at their discretion.
