CLOSED SESSION <br />A. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION <br />Significant exposure to litigation pursuant to Government Code section 54956.9(b) <br />Number of potential cases: 1 <br />PUBLIC COMMENT ON CLOSED SESSION <br />The following community members addressed the Council: <br />Jerry Almendarez, Colton Joint Unified School District, regarding the use of athletic fields at <br />Colton Middle School. <br />Mayor Pro Tem Gonzales adjourned the closed session portion of the meeting and at 5:30 p.m., <br />the special meeting reconvened. Roll Call was announced by City Clerk Gomez with all <br />members present as heretofore. <br />City Attorney Derleth reported that in closed session, Council authorized a check in the amount <br />of $543,347.43, to be paid to the Colton Joint Unified School District. This amount was owed to <br />the school district according to a prior pass through agreement. Any additional amounts will be <br />forwarded to the Oversight Board. <br />BUSINESS ITEMS <br />(1) Amended Enforceable Obligation Payment Schedule — Approved and Adopted an <br />Amended Enforceable Obligation Payment Schedule Pursuant to Part 1.8 of Division 24 <br />of the California Health and Safety Code, RESOLUTION NO. 897. <br />City Manager Foster presented this item and explained that the Oversight Board will be <br />coordinated in May as part of the winding down process of the Redevelopment Agency in <br />accordance with the State of California. <br />Motion and second by CM Bennett/CM Perez, to move forward with staff recommendation. <br />Motion carried with Mayor Zamora and CM Yzaguirre being absent. <br />(2) Successor to Housing Assets and Functions - Approved and Adopted a Resolution <br />Selecting the Public Entity (either the City, the Colton Housing Authority or the Housing <br />Authority of the County of San Bernardino) to Assume the Housing Assets and Functions <br />previously Performed by Redevelopment Agency for the City of Colton Pursuant to Part <br />1.85 of Division 24 of the California Health and Safety Code, RESOLUTION NO. R-02- <br />12. <br />City Manager Foster explained the winding down process of the Redevelopment Agency. There <br />were also comments from City Attorney Derleth and City Attorney Williams regarding staff s <br />recommendations and the proposed action including the three (3) options. <br />Motion and second by CM Toro/CM Oliva, to adopt Resolution No. 02-12, choosing Option No. <br />2, electing NOT to retain such housing actions and functions and selecting the Colton Housing <br />Authority as the entity to assume the housing assets and functions.
