City Attorney Edwards read Mayor Gonzales' memorandum regarding review of the City's position on the Rialto Tire Burning Plant, stating that the Counties of Riverside and San Bernardino, and the Cities of River- side, Grand Terrace, Fontana, Big Bear Lake, Palm Springs, Moreno Valley, and Redlands have formed a group to oppose the proposed Plant. Mr. Edwards said it is anticipated that the Cities of Coachella Valley and Loma Linda will also be joining. City Attorney Edwards continued the group has agreed to retain special counsel of Best, Best & Krieger to bring a lawsuit against the appro- priate parties to stop the proposed project. Mr. Edwards advised that Colton and the six smaller cities will each pay $5,000 for fees and costs. Mr. Edwards then referred to correspondence written by Senator Ruben Ayala to Attorney General John Van De Kamp expressing concern over the health risk to the citizens from a project of this nature. Mayor Gonzales stated he has received many telephone calls opposing the construction of this plant in our immediate area, and stated he would recommend that Colton join the other cities in opposing the Garb Oil Power Plant, and adoption of Resolution No. R-11-87. Moved by Councilwoman Cisneros, seconded by Councilman Rehrer, to ap- prove Resolution No. R-11-87. Unanimous vote. RESOLUTION NO.—R-11-87 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON AUTHORIZING FILING SUIT OPPOSING RIALTO TIRE BURNING PLANT AND AUTHORIZING FUNDS THEREFOR. Boards & Commissions Mayor Gonzales referred to his memorandum regarding appointments to the Civil Service Board, Cemetery Commission, and Utilities Commission, stating nominations from the Council would be in order. Councilman Rehrer asked if this matter could be continued to the next regular Council Meeting. On Council consensus, the appointments to Boards & Commissions was con- tinued to the next regular Council Meeting, February 3, 1987. PUBLIC HEARINGS: Landscaping & Lighting Maintenance District No. 1 Res. No. R-12-87 Mayor Gonzales declared the Continuation of the Public Hearing. City Clerk Ramos submitted the Affidavit of Posting the Continuance and reported that no protests or objections had been received. 3
