Contractor shall <br />regularly train its employees in Customer courtesy, shall prohibit the use of loud or profane language <br />and shall instruct Collection crews to perform their work as quietly as possible. Contractor shall <br />encourage drivers to introduce themselves to Customers who may be present during pickup in order <br />to develop and maintain good community relations, without penalizing them for lowered productivity. <br />Contractor shall encourage drivers to attend community events and functions. Contractor shall <br />maintain an incentive program for personnel to encourage good community relations, including <br />particularly rewards for zero Customer complaints. Conversely, if any personnel is found not to be <br />courteous or not to be performing Services in the manner required hereby, Contractor shall promptly <br />take all appropriate corrective measures. <br />(3) Field Sunervision. Contractor shall provide one qualified personnel as on-site supervisor of field <br />operations who shall be equipped with a vehicle and two-way radio or mobile telephone and shall <br />devote all of his or her time in the field within the City, checking collection operations, coordinating <br />improvements to Service, resolving field problems and responding to complaints of Customers in <br />persons or by telephone. Drivers in Vehic(es shall also be equipped with a two-way radio or cell <br />phone. <br />(4) Kev Personnel. Contractor acknowledges that its obligations to provide Services hereunder are <br />personal in nature, and that Contractor's identification of key personnel responsible for assuring <br />complete and timely performance of Contractor's Services listed in Exhibit 4.Oli(4), including the AB <br />939 Program Coordinator and Contractor's supervisor, was a significant factor in City's selection of <br />Contractor and execution of this Agreement. Contractor shall provide City at least thirty days' Notice <br />of changes in such key personnel, in which event it shall update such Exhibit 4.Oli(4). <br />(5) No Gratuities. Contractor shall not permit its personnel to demand or solicit, directly or <br />indirectly, any additional compensation or gratuity from Customers or any members of the public. <br />(6) Nondiscrimination. In the performance of all work and Services hereunder Contractor shall not <br />discriminate against any person on the basis of such person's race, sex, color, national origin, religion, <br />marital status or sexual orientation. Contractor shall comply with all Applicable Law regarding <br />nondiscrimination, including those prohibiting discrimination in employment. <br />(7) Compliance with Law. Contractor shall keep all records indicating compliance required by the <br />Federal Immigration and Control Act of 1986 and shall make such records available for inspection by <br />the City upon request. <br />(8) Affirmative Action. Contractor shall comply with all Federal and State laws in regard to <br />Affirmative Action polices and guidelines. <br />5/06/97 execution <br />17 <br />
