City reserves the right to require a Customer to use a larger Container or <br />additional Containers in any case where City determines that the Customer has inadequate capacity <br />for the vo(ume of MSW generated on Customer's premises. If City so directs Contractor, Contractor <br />shall exchange existing Container(s) for of Container(s) a different size or provide additiona] <br />Container(s) within seven days of City's direction. <br />(3) Annual Cleaning of Containers. Contractor shall clean all commercial Containers once each <br />Contract Year without charge and Containers which hold primarily putrescible MSW, including <br />grocery stores and restaurants, more frequently as necessary to prevent odors, reduce vectors and <br />project a presentable appearance for charges listed in Exhibit 10.01. <br />(4) Repair or Replacement of Commercial and Residential Containers. Contractor shall repair <br />Commercial Containers within twenty-four hours of a request for repair from a Customer or from the <br />City Representative or, if the repair cannot be completed within such twenty-four hours, shall provide <br />such Customer with a replacement Container at a price no greater than repair would have been, for <br />the charges listed in Exhibit 10.01. Residential containers shall be repaired or replaced by Contractor <br />at no charge to the resident. This service will be done on the next regularly scheduled collection day. <br />(5) Materials Identification. Containers must be in bright, readily identifiable colors, subject to City <br />approval, to facilitate Customer's ready recognition of Refuse, Green Waste and Recyclables discards. <br />Contractor shall provide and emboss information, subject to City approvaL <br />i. Personnel. <br />(1) Driver Licensing and Safetv. Contractor shall ensure that all drivers of Vehicles have in full <br />force and effect valid licenses of the appropriate class issued by the California Department of Motor <br />Vehicles. Contractor shall provide suitable operational and safety training for all of its personnel, <br />including those who drive Vehicles or operate other equipment for Collection, which training shall <br />include on job-training by supervisors. Contractor shall train drivers so that they may drive all <br />Collection routes, interchangeably, but shall use Reasonable Business Efforts to assign the same <br />driver(s) to identified routes in order to encourage accountability and enhance Customer relations. <br />Contractor shall train its drivers to identify and not to collect Hazardous Waste. Contractor shall <br />implement drug and alcohol testing in accordance with Applicable Law. Contractor shall maintain <br />photostat copies of licenses for all Vehicle operators and full and complete records of training and <br />testing, which Contractor shall make available to City during Office Hours. <br />(2) Identification, Apnearance, Conduct. Contractor shall require its drivers and all other <br />personnel who come into contact with the public to wear a uniform, approved by the City, identifying <br />the name of each such driver or other personnel, which shall be cleaned and pressed daily.
