In answer to <br />Councilmember Sandovalf s request, City Attorney Biggs informed that <br />she met with Spacial Counsel, Tim Sabo, about the Contract <br />Management Agreement with Steward a:d Associatesf particularly <br />about <br />financing. he Certificate of a�° 1 i ati (COP) o o e ways of <br />City Attorney Biggs advised that the Amendment to the Contract <br />Management Agreement before Council included language to allow <br />financing through Pl "or by any legal means designated by the <br />City. to The Cityt position is to keep its options open on the <br />question of financing. She said that COP,�s may not be how the city <br />Council determines to go. This Amendment will allow that payment <br />of the $750,,000 for pro)ect coats shall be reimbursed to the <br />Contract Manager from legally available funds of the City upon <br />submittal of appropriate invoices and verification of payment: b <br />the Contract Manager. <br />City Attorney Biggs inform.ed that the reference to specific payment <br />through COP of $10,000 per month for ten months has been deleted. <br />This provides flexibility. The <br />amount o $75,000 has been incurred the <br />City and <br />reimbursed to Mr. Steward. On the $10,000 per month or ten months <br />and other monies to be incurred in the construction of the <br />i ty center,, the City Manager stated he was looking for more <br />commun <br />financial options. With the community center project and the Metra <br />Mall Pro3ect anti ipatedo Members of the City Council asked to be <br />kept abreast. of figures and financing. <br />Mayor Gonzales directed that a roll call vote be taken on the <br />question o S Amendment No. I to the Contract Management Agreement. <br />Motion carried with Counci,member Beltran abstaining from vote upon <br />the advice from counsel. <br />City Attorney Biggs declared. that Co ncilm mbar Beltran didnot <br />participate in any an.ner in the discussion that took place on Item. <br />10, under the advice of his own counsel, in the event a conflict <br />exists. <br />Item No. 11 <br />As requested by Councilmember Beltran, Mayor Gonzales directed that <br />roll call vote be taken on the question of two lease agreements <br />itb IC A..
