Unanimous vote. <br />ORDINANCE NO. 0-02-94 - AN ORDINANCE OF THE CITY COUNCIL OF THE <br />(First Reading) CITY OF COLTON, CALIFORNIA, REVISING <br />CHAPTER 18.50 OF THE COLTON MUNICIPAL <br />CODE REGARDING PROPERTY MAINTENANCE <br />STANDARDS AND PROCEDURES WITHIN THE CITY. <br />Prosecution of Misdemeanor as Infraction <br />Mayor Gonzales announced that this was the time and place fixed for <br />Public Hearing for Consideration of an Amendment to Chapter <br />1.12.030 of the Colton Municipal Code which would Allow the City <br />Attorney to Prosecute Certain Misdemeanor Violations as <br />Infractions. <br />Mayor Gonzales declared the Public Hearing open. <br />City Clerk Ramos submitted the Affidavit of Publication and <br />reported that no protests or objections were received. <br />Community Development Director Zamora reported that Planning <br />Commission has recommended approval of an amendment to Title 18 of <br />the Colton Municipal Code (Zoning Ordinance) which will allow the <br />City to proceed with any misdemeanor code enforcement matter as an <br />infraction. Staff anticipates no financial impact to the City. <br />Staff recommended passage of First Reading of the proposed <br />ordinance. <br />There being no response for public comment, on motion by <br />Councilmember Cook, seconded by Councilmember Cisneros, to <br />terminate the Public Hearing. Unanimous vote. <br />Councilmember Rios asked for an explanation. City Attorney Biggs <br />informed that the legal process will be the same; however, the <br />defendant will not have an automatic right to trial. This will <br />provide a solution to a continuing problem. It will accelerate the <br />process. There is no incarceration to be imposed but a fine can be <br />levied. <br />Motion by Councilmember Sandoval, seconded by Councilmember Rios, <br />to waive full reading and pass First Reading of Ordinance No. 0-03- <br />94.
