Mayor Fulp stated he had <br />given his request due consideration. <br />Agency Appointments <br />Councilmember Sanders tendered his resignation as Member <br />representative from the San Bernardino Valley Municipal and <br />nominated Councilmember Hutton to sit in his stead and he <br />volunteered to serve as alternate. Mayor Fulp asked for legal <br />opinion and City Attorney Biggs said that procedure is informal. <br />Councilmember Beltran moved, seconded by Councilmember Bennett, to <br />accept Councilmember Sander's resignation, to ratify the <br />appointment. Unanimous vote. <br />Sanitation <br />Councilmember Hutton stated his presentation was in response to <br />Councilmember Sandoval's request for a status report. Director <br />Hutton said the Department was going to advertise the fact that <br />they are starting to prepare the commercial bins. In the <br />meantime, Councilmember/Director Hutton said that staff was <br />proposing a compromise resolution to freeze all hauling rates for <br />a period of six months. Councilmember Sandoval expounded that in <br />response to numerous telephone calls, it appears that the City knew <br />there would be early problems to overcome, that it could not <br />anticipate areas of transition and there exists a need to look at <br />an equitable rate structure. The rate freeze would afford the City <br />an opportunity to look at the rate structure, help staff adjust <br />rates and address the needs of the City. <br />City Attorney Biggs stated that after a meeting last night at La <br />Cadena Creek, to help alleviate the confusion, she had been asked <br />by Councilmember Sandoval to prepare the proposed resolution. <br />Councilmember Bennett objected strenuously regarding a way to work <br />in an increase. She declared the department was currently running <br />over the budget and that this was not the way to regulate it. She <br />emphasized that the City is to provide service to the community not <br />create a monopoly for the City. She stated that the City is here <br />to provide efficient and effective service and the Council should <br />allow that existing companies to provide that service. <br />Councilmember Sandoval said the question was not to decide the <br />question of hauling waste as this was determined by a 6-1 vote by <br />the present Council. He reiterated that it was prudent to evaluate <br />the rate structures. <br />Motion by Councilmember Beltran, seconded by Councilmember Bennett, <br />to consider an alternate motion that (1) the City have a management <br />audit on sanitation and recycling and (2) extend those haulers now <br />in place, on a month to month basis, for the six months of the <br />freeze, and that all private haulers provide an "X" amount of <br />dollars for such audit and the City Manager is to be allowed to <br />W7 <br />APR 0 4 1995 <br />
