City Attorney Biggs advised this was not a City <br />problem and advised that it would be appropriate for the <br />individuals who have had serious problems to band together and seek <br />legal counsel on their own and take action against the developer, <br />and so on. She also recommended that the homeowners contact <br />Insurance Commissioner Garamendi. <br />Mr. Jim Jones, 3050 Canyon Vista, stated he wanted some feedback as <br />to what the responsibility of the developer is with regard to these <br />problems. City Attorney Biggs again advised that the homeowners <br />needed legal counsel and that the City cannot represent them as <br />this is a private matter. <br />Mr. Jones asked if anything could be done about the dangerous <br />condition on Reche Canyon turning left onto Prado. Councilmember <br />Bennett said the area is in the County pocket and the County has <br />plans to put a signal there in 1996 and also at Westwood. Mr. <br />Jones asked if there was anything the City could do in the interim. <br />City Attorney Biggs said it was outside of the City's jurisdiction; <br />therefore, the City could only encourage the County to move <br />forward. Public Works Director Hutton said the City does not pay <br />to build facilities outside the corporate boundaries. He <br />recommended the Mayor send a letter to the Board of Supervisors. <br />Mr. Jones asked that something be done as the school buses are <br />having a difficult time turning and the safety of the children must <br />be protected. Mayor Fulp reported he would be meeting with <br />Supervisor Eaves and would bring this matter up. <br />Mr. Anderson addressed the Council saying he does have an attorney <br />and it is costing thousands of dollars. He said the Council does <br />have the power to get involved and litigate against the developer. <br />Mayor Fulp said he finds himself in a difficult situation because <br />he knows Mr. Anderson personally and has seen the damage to this <br />home. The tract was built to specs and code and therefore this is <br />a very tough subject. <br />Censure, Fire Debt. <br />Mr. Rocky Fredrickson, asked what affect does the censoring of <br />Mayor Fulp have on the public. City Attorney Biggs replied that it <br />did not affect the public. Mr. Fredrickson asked where did the <br />bogus figure come from on the Fire Department salaries. City <br />Manager Martinez responded the figures should have come through the <br />City Manager. The information did not come from him nor through <br />him. There was a cover memorandum from the City Treasurer. City <br />Manager Martinez said after he received the material he found some <br />high numbers, several of which included the payoff for vacation and <br />other benefits as the individual was leaving his employment with <br />the City.
