regarding the City's wastewater treatment facilities to update and <br />expand currently available engineering reports so that a report <br />which identifies all needed improvements to the City's current <br />treatment facilities together with any necessary expansion of those <br />facilities required to meet the reliability requirements for the <br />City's wastewater treatment system as set forth in Cease and Desist <br />Order 36-95 can be prepared and submitted to the California Water <br />Resource Control Board, Santa Ana Region, no later than June 15, <br />1995; (3) upon receipt of the Engineering Report the City Council <br />commit to a defined schedule to consider the recommendations <br />presented in the Engineering Report and to decide how to proceed to <br />assure the necessary reliability of the City's wastewater treatment <br />system; (4) that City Council commit to implementing reasonable <br />limitations on new commitments for connections to the City's <br />wastewater system to assure that the City's treatment capacity is <br />not exceeded during the decision-making process in which the City <br />Council will ultimately determine how to proceed to assure full <br />reliability of its wastewater system; that City Council approve and <br />implement any required funding mechanism to cover the costs of any <br />repairs, improvements or expansion identified by the Engineering <br />Report; and, that the City Council commit to proceed to make the <br />needed repairs, improvements or expansion and establish a schedule <br />indicating a reasonable and specific time frame for completion. <br />Mr. Cordova said he understood the Cease and Desist Order had been <br />extended to November 15th. City Attorney Biggs clarified that the <br />extension is for the tertiary treatment. Commissioner Cordova <br />emphasized that the expansion is necessary in the near future. <br />Councilmember Beltran questioned how an independent study could be <br />made by engineering firms currently working for the City and he <br />suggested the City do a Request for Proposals for selection of a <br />different firm. Councilmember Hutton said he agreed with the <br />Utilities Commission's recommendation as the three firms - <br />Montgomery Watson, Kennedy -Jenks and Krieger and Stewart - <br />collectively possess twenty plus years of knowledge and experience <br />with the City's water and sewer operation and utilizing them would <br />expedite compliance. City Attorney Biggs said there is no problem <br />using any of them as they are independent firms and the City <br />contracts with them. If they have done everything but an update, <br />there would be no problem if one is chosen. Mayor Fulp stated he <br />attended the Utilities Commission's first meeting. He asked if the <br />City did the repairs and brought things up to date would the Water <br />Board be lenient with the Cease and Desist date. Mr. Cordova <br />answered "yes." The important thing is expediency. The problem <br />appears to be capacity. There is nothing available to empty into <br />and do the repair work. SARI is not expected to be ready until <br />October. The plant has a total 6.4 MBG capacity and the city is <br />currently to a level use of 4 MBG. <br />City Manager Martinez reported that Mr. Addelson had heard him.
