ADJOURNED CITY COUNCIL MEETING <br />FEBRUARY 21, 1996 <br />In accordance with notice duly and legally given, an Adjourned Regular Meeting of the City Council of the <br />City of Colton was held on the above given date at 5:07 P. M., in the Council Chambers of City Hall, <br />Mayor Fulp presiding. <br />ROLL CALL: <br />Councilmembers present were Hutton, Hansen, Bennett, Cook, Sanders, Beltran and Mayor Fulp. Also <br />present were City Attorney Biggs, City Manager Martinez, and City Clerk Freeman. <br />PUBLIC HEARINGS: <br />Public Works <br />Mayor Fulp declared this was the time and place continued to for consideration and adoption of a resolution <br />declaring its intention to cause construction of certain improvements pursuant to the provisions of Section <br />5870 et LN., of the Streets and Highways Code of the State of California (Agua Mansa, between Rancho <br />Avenue and 5th Street.) <br />Mayor Fulp declared the Public Hearing once again open. <br />City Clerk Freeman re -submitted the Affidavit of Publication and announced that a Letter of Objection was <br />submitted by Mr. Fred G. Rueff on February 6, 1996. <br />Mr. Fred Rueff, 450 Agua Mansa Road, said he also owned the two adjoining parcels. He said he was <br />opposed to the curb and gutter proposition because of the major problem is flooding on Agua Mansa Road. <br />He said the proposed curb and gutter would be done along the front of his roperties and nothing would <br />p <br />be done to the other side, which belongs to the Colton Unified School District. After discussion with the <br />School District, his representative found that the City of Colton and the homeowners are responsible for <br />any construction project. He suggested all property owners in the effected area be required to participate, <br />to have the project done thoroughly and properly, and, alleviate the existing problems. The whole road <br />would need to be re -engineered. He said putting curb and gutter at this time would make matters � worse <br />as it would block the water and not allow it to run through the property. He proposed to wait until the job <br />could be done right and get both sides of the street done and get a storm drain. He presented pictures of <br />the flooded area, for 1996 and 1976. <br />There was discussion on improving the school side. Mr. Rueff suggested CDBG grant funds be used. <br />Councilmember Beltran inquired about directing the school to do their side. Councilmember/Director <br />Hutton said that under the Government Code, the 1911 act is not allowed unless there is 60% participation <br />FEB 21 1996 <br />
