After lengthy debate, motion by Councilmember Beltran, seconded by <br />Councilmember Sanders, to deny and reject Resolution No. R-16-96. <br />Mayor Fulp accepted responsibility for the confusion and <br />insensitivity of the language found in the proposed resolution; <br />however, since he believed that it was immoral and wrong for part- <br />time officials to take life -time benefits from the City, he <br />promised to return with this item at a future date. <br />Mr. Max Lofy read from a memorandum authored by the law firm of <br />Best, Best & Krieger which stated that "...the City Council may not <br />terminate any vested right..." The legal opinion concluded that <br />the rights vested upon a contractual provision were protected by <br />federal and state law. <br />The above motion carried upon unanimous vote. <br />Item 32 - Audit <br />Finance Director Vega introduced Mr. Bob Samario of Moreland & <br />Associates, who provided a recap of the audit progress. He said <br />the general fund audit, including Rancho Med, was accomplished in <br />four and one-half weeks. He said the RDA audit would be next, <br />estimated to take another four and one-half weeks to complete. He <br />anticipated the entire audit would conclude by the first week in <br />April. Councilmember Sanders inquired what was unique about the <br />audit and Mr. Samario said that Rancho Med audit was complicated as <br />work was left undone which had to be reconstructed and it absorbed <br />the majority of their time. Mr. Samario estimated that a draft of <br />the FY 1994-95 audit would be ready in early April. <br />Motion by Mayor Fulp, seconded by Councilmember Cook, to approve an <br />additional $7,200 to Moreland and Associates for client assistance <br />related to the annual audit for fiscal year ended June 30, 1995. <br />Councilmember Hutton recalled a "growing concern" statement in FY <br />1993-94 audit and asked if one was predicted in FY 1994-95. Mr. <br />Samario explained that such an indication is projected a year ahead <br />and that Moreland and Associates would be looking at the fiscal <br />picture more closely. <br />Above motion to approve additional client assistance carried upon <br />unanimous vote. <br />Item 31 - City Clerk Supplemental Compensation <br />City Clerk Freeman indicated he has started a number of programs <br />since taking office, namely, professionalization of the office and <br />digitization of records. <br />Motion by Councilmember Sanders, seconded by Councilmember Hutton, <br />to approve and adopt the resolution setting the supplemental <br />3 <br />FEB 2 0 1996 <br />
