the approval of the city council shall make all appointments to boards, commissions and committees <br />unless otherwise specifically provided by statute (by state law). <br />She stated the current ordinance complies with the requirement that such appointments be approved by <br />the entire City Council, it does not comply with the corollary requirement that the Mayor make all such <br />appointments and that the proposed ordinance clarified that the appointments by the Mayor would be <br />made upon recommendation of the various Councilmembers, by district. She finther indicated that the <br />Mayor or any subsequent Mayor could assert the authority of state statute, as the City was pre-empted <br />from having a different law from state law. In addition, for consistency, the ordinance stated that an <br />appointee could be removed by the majority vote of the City Council. <br />Motion/second by CM Sandoval/Bennett to take no action on Ordinance No. 0-1-97, amending <br />§2/30.020, §2.30.030, and §2.30.070 relating to appointments of members of city commission and <br />committees. <br />Jim Ott, Charles Jackson, Steve Anderson, Colton residents, spoke in support of no action be taken on <br />Ordinance No. 0- 1 -97. <br />City Attorney Biggs responded regarding any penalties if the ordinance was not adopted by stating there <br />was no penalty. She said it would be preferable to be in compliance with the 1971 state statute but there <br />is no negative consequence. The appointments, as long as they are ratified and approved by the <br />Council, were valid. <br />Fred Cordova, Colton resident, spoke for the need for guidelines for Commissioners to follow as there is <br />nothing in place. He also gave his interpretation of the do's and don'ts of a Commissioner. <br />Discussion continued and the vote on the motion carried with CM Hutton voting "NO." <br />Rescission of Ratification of Planning Commission A A for District 5 <br />j2pointmen <br />City Attorney Biggs announced that this matter is also a Closed Session matter of significant exposure <br />to litigation and advised Council that the Closed Session item be discussed first. <br />Claudia Ross, Grand Terrace resident, and Steve Anderson, Colton resident, spoke against removal of <br />Planning Commissioner for District 5. <br />Jim Ott, Planning Commissioner for District 5, spoke against his removal as Planning Commissioner. <br />CLOSED SESSION: <br />City Attorney Biggs announced that the City Council would meet in Closed Session pursuant to <br />Government Code §54956(b) to confer with Legal Counsel regarding one matter of significant exposure <br />to litigation. <br />4 <br />
