Motion/second by CM Sanders/Hutton, to approve staff's recommendation <br />amending the contract with Topping Jaquess Consultants, Inc. Motion carried <br />with CM Sandoval absent. <br />(10) Bid - Awarded Bid for Rubberized Protective Surfacing Veteran's Park to <br />Spectraturf, Inc., in the amount of $16,445.00. <br />(11) Agreement - Approved Future Annexation Agreement for Lido Motel at 1087 W. <br />Valley Blvd., for Connection to the City's Sewer System. <br />Motion by Councilmember Hutton, seconded by Councilmember Bennett, to approve and <br />adopt the Consent Calendar except for Items 2, 8, and 9. Motion carried with Council - <br />member Sandoval absent. <br />John Mitchell, Parks & Recreation Chairperson, commented on Item 10 expressing his <br />concern as to the type of repair that will be done at Veteran's Park and hoped it would not <br />be patchwork repair but something more permanent. Mr. Mitchell referred to Item 12 of <br />the Agenda and felt it was unfair to tell a Councilmember who should serve on a <br />Commission. <br />Jean Hart, Colton citizen, commented on the following: repair work that was completed <br />on her street and a neighbor's garbage disposal bin knocked over by motorist's driving <br />through the neighborhood.. <br />MAYOR AND COUNCIL ITEMS <br />Board and Commission <br />Mayor Gaytan presented the following item for discussion: Ratification of Planning <br />Commission Appointment for District 5. Mayor Gaytan informed the Council that a vote <br />must be taken to reconsider the appointment in order to act. <br />City Attorney explained the rules of procedure and explained that it does allow for <br />reconsideration if there is a two -third's vote of the Council. <br />Councilmember Bennett referred to the Ordinance regarding Commission appointments <br />and the reasons listed for removal and that Commissioners serve at the discretion of the <br />Councilmember. <br />Councilmember Sanders informed Council that he received correspondence from Attorney <br />Biggs that affects the item being discussed. <br />Councilmember Bennett felt that if the situation could result in a possible litigation <br />problem then it should be discussed in Closed Session. City Attorney Biggs concurred but <br />stated Council needs to vote to consider the ratification of the appointment before it can <br />3 <br />
