direct staff to negotiate terms of the contract to include current state laws regarding waste <br />diversion, franchise fees and the limits of collection, all within the parameters of a proposed <br />resolution [not agendized for tonight's meeting]. <br />City Attorney Carvalho inquired if the motion to approve the request on condition that staff <br />obtain the reasonable AB939 items. CM Hutton agreed that it was conditional. He believed that <br />it was Jack's Disposal's intent to continue the services they currently provided. <br />On the conflict of interest charge, CM Chastain stated she received a $1,000 campaign <br />contribution, duly reported on FPPC Form 490, and asked for a legal opinion. Under the <br />Government Code and Fair Political Practices regulations, City Attorney Carvalho advised that <br />campaign contributions were not deemed to be sources of income for purposes of disqualifying <br />elected officials from voting on a matter. <br />For clarification of direction, City Attorney Carvalho inquired if the main motion was <br />conditioned upon staff adding AB939 indemnification and other state law mandates, to include <br />other contract points, such as administrative fees, so as to have parity between the two <br />contractors. <br />MOTION/VOTE: After discussion, motion by CM Hutton, seconded by CM Grimsby, to call <br />for the question carried. with CM Bennett absent. <br />� Mayor Gaytan reiterated the primary motion .by CM Hutton, seconded by CAVI Grimsby, to <br />approve the request by Jack's Disposal, for extension to the year 2006, with the proviso that they <br />negotiate those requirements that are now current law, and to have staff return at the next <br />meeting, the contract and a resolution. Motion carried with CM Sanders and CM Chastain voting <br />"No" and with CMBennett absent. <br />RECESS: <br />At 10:08 P. M., Mayor Gaytan declared a brief recess and at 10:25 P. M,, the meeting was <br />reconvened with all Members present except CM Chastain. <br />PUBLIC HEARINGS: <br />STREET CLOSURE - CANTERA STREET <br />This was the time and place fixed to consider the closure of Cantera Street at San Bernardino Avenue. <br />Mayor Gaytan declared the Public Hearing "open." <br />City Clerk Barrera declared the Affidavit of Publication was on file in the City Clerk's Office and <br />reported there were no protests or objections thereto. <br />Assistant City Manager Daryl Parrish made brief presentation of his written report and recommended <br />approval of the proposed resolution. <br />Council Mins August 18, 1998 3 <br />
