City Attorney Carvalho explained that under Redevelopment law, the City can use redevelopment <br />funds for public improvements after making formal findings that (1) there are no other alternatives and <br />(2) the improvements assist in eliminating blight within the project areas. She advised it did not <br />appear, based on the facts presented, that the criteria would be met. <br />John Reichel, Housing Developer, said there would be no major impact on the housing market and <br />described the water/sewer connection fees associated with the development process. <br />MOTION/VOTE: CM Sanders moved to amend the original motion for passage of Ordinance No. <br />0-15-98, as corrected, to include the HUD criteria for seniors. Amendment to the motion was <br />accepted by CM Chastain, who seconded the original motion. Motion carried with CM Hutton voting <br />"No" and CM Bennett absent. <br />RECESS• <br />At 8:50 P. M., Mayor Gaytan declared a recess and at 9:18 P. M., meeting was reconvened with all <br />Members present, including CM Bennett who assumed her place on the dais. <br />PUBLIC COMMENT: <br />Mark Williams complained, about drainage problems at the bottom of his street. City Manager <br />Garcia reported the City had an oral agreement for access to the property; however, subsequent to <br />a recent meeting with the former property owner's widow, all access to the property was denied. <br />Legal Counsel advised that the City could proceed with an emergency abatement and obtain a <br />court order. The City Manager agreed to talk to the owner, again, and provide a report. <br />John Longfield thanked City Manager Garcia for the recent Commission Orientation Workshop <br />and he thanked City Clerk Barrera for her stand on the recall activities. <br />William Yahn spoke on water rates, accountability, the stormwater rates and Taormina. <br />Fred Cordova pointed out the increase in traffic of heavy trucks on Seventh Street and raised <br />questions regarding excessive speed, damage to streets and limited access. <br />After his presentation at the last Council meeting, John Mitchell said he had been harassed and <br />threatened. <br />MAYOR AND COUNCIL ITEMS: COMMENTS, INTER -GOVERNMENTAL AGENCY <br />REPORTS, INFORMATION SESSION: <br />Boards and Commissions <br />MOTION/VOTE: At CM Hutton's request, motion/second by Mayor Gaytan/CM Bennett to <br />ratify the appointment, for District 2, of Terry Dorman to the CFD Commission carried with no <br />opposition. <br />District 6 <br />Council Mins July 21, 1998 4 <br />
