Community Development Director Zamora reported that applicant's request for approval of a parking <br />lot expansion to create 56 additional parking spaces was approved by the Design Review Committee <br />with certain conditions including the City Engineer's requirement to complete a drainage channel. <br />Director Zamora stated that the required condition was now being appealed and that Staff <br />recommended denial of said request. <br />Mr. Fred Frank, Director of Reche Canyon Rehabilitation, stated applicants had not been aware of the <br />drainage channel requirement. He spoke about the growth of the facility and limited parking, forcing <br />people to park their vehicles in the fire lane where they have blocked emergency vehicle access at <br />times. As the parking lot was not attached to the facility, he said that Architect Jonathan Zane had <br />advised that conditions could not be attached to the approval of the off-site building project. Director <br />Zamora responded. <br />MOTION/VOTE: Motion by CM Hutton, seconded by CM Sanders, to terminate the Public <br />Hearing carried with Mayor Gaytan absent. <br />Motion/second by CM Hutton/Bennett to refer this item to the City Attorney for analysis and legal <br />opinion on (1) correspondence, dated 9-27-90, from legal counsel for Inter -west Medical Corporation, <br />(2) possible liability problems to the conditions on a state regulated facility and (3) whether the City <br />has authority to permit a medical facility under the State Architect's Office. Motion carried with <br />Mayor Gaytan absent. <br />UNFINISHED BUSINESS: <br />Fee Increase for Private Pay Families attending Community, Childcare Latchkey Programs <br />Childcare Manager Jones reported State was greatly concerned at the rates being charged by the <br />City. State warned the City was jeopardizing the contract and the program. Manager Jones said <br />severe sanctions could be imposed, i.e., revoking of the contract or reduction of the State rate <br />currently provided, a reduction of $90,000. <br />Discussion followed on a bill, announced in the WASHINGTON FAX REPORT, in the area of <br />Childcare subsidy funding. Discussion also had regarding the use of CDBG funds and as to other <br />types of programs available such as the San Bernardino magnet program. <br />MOTION/VOTE: Primary motion and second made by CM Hutton/Chastain to approve Staff's <br />recommendation with direction for the City Attorney's analysis on the question of whether the <br />City can subsidize funding in the future. Motion carried with Mayor Gaytan absent. <br />Motion/second by CM Grimsby/Sanders to have the City Manager to investigate and report on <br />June 23', on partial subsidy specifically, three months at 100% of the increase and nine months <br />at 50%, and to return at mid -year with a strategic plan regarding the subsidy issue and State <br />relevancy.
