Significant Exposure to Litigation pursuant to Government Code Section 54956.9(b) and (c): <br />Number of potential cases: 3 <br />RECESS: <br />At 6:15 P. M., meeting adjourned to Closed Session and at 8:53 P. M., the meeting was reconvened <br />with all Members present. <br />CLOSED SESSION (Continued) <br />Interim City Attorney Carvalho declared the City Council did meet in Closed Session and considered <br />the following items: <br />A. CONFERENCE WITH LABOR NEGOTIATOR <br />ACTION: No reportable action. <br />B. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION <br />ACTION: No reportable action. <br />C. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION <br />ACTION: City Attorney Carvalho reported the City Attorney made a recommendation that <br />the City Council receive and file the McDonald Report, which concerned solid waste issues in <br />the City. <br />It was the City Attorney's recommendation and the City Council's decision to make the <br />following statement: The City Council formally declines to confirm, to endorse or otherwise <br />validate, purported findings and conclusions of the McDonald Report. These decisions were <br />based upon an opinion that the report's tone, innuendo and speculative nature lays questions <br />as to its objectivity and that these issues were confirmed by such organizations as the San <br />Bernardino District Attorney's Office, the Orange County District Attorney's Office, the Fair <br />Political Practices Commission and the Grand Jury. <br />VOTE: This action was taken by 6-1 vote, with CM Hutton voting "No." <br />UNFINISHED BUSINESS: <br />Establish Term Limits: <br />Interim City Manager Carvalho submitted a staff report with the correction that in 1994 the electorate <br />voted to extend the mayor's term to four years. Following the directive to submit an ordinance that <br />imposed a two -term limit, she indicated that the proposed term limit provisions did not address <br />situations where people are appointed or elected to fill a term that is already in progress. She <br />requested further direction to address the issue, revise the ordinance and return to Council. <br />Council Mins March 03, 1998 2 <br />
