CITY OF COLTON <br />CITY COUNCIL REGULAR MEETING MINUTES <br />AUGUST 3, 1999 <br />Regular Meeting held on the above given date at 6:10 P. M., in the Council Chambers of City <br />Hall, with Mayor Gaytan, presiding. <br />FLAG SALUTE: <br />Council Member DeLaRosa led the Pledge of Allegiance. <br />INVOCATION <br />Chaplain Robert Johnson offered the invocation. <br />ROLL CALL: <br />CM Donald J. Bennett <br />City Attorney Carvalho <br />In pending litigation challenging the City's Utility Users Tax, City Attorney Carvalho indicated <br />that after discussion, this date with Ms. Brown and her attorney and attorney for the Plaintiffs, <br />unanticipated progress was realized which needed to be reported to City Council for possible <br />resolution of the case. Further, she stated the matter was urgent because of pending discovery <br />dates and if the matter were resolved, there would be no need to spend attorney fees. She advised <br />that to add the item to Closed Session, it required a four-fifths vote. <br />MOTIONNOTE: Mayor Gaytan, seconded by CM DeLaRosa, moved to add the item as stated <br />pursuant to G. C. Section 54956.9(a), as Existing Litigation, namely, Gwen Brown, et al vs. City of <br />Colton, to be added to Closed Session as Item B.
