MOTION/VOTE: Mayor Gaytan moved to add the item as stated. CM Bennett seconded the <br />motion and it carried on unanimous vote. It was listed as "three" under Item " C. " <br />UNFINISHED BUSINESS: <br />Power Sales Aereement <br />Utility Director Clarke stated the item had been pulled from the last agenda for minor contract <br />language changes and that clarifications had been made and all attorneys had agreed. Director <br />Clarke recommended ratification of the power sales agreement between the City of Colton and <br />America Utility Network, to sell retail outside the City limits. <br />MOTION/VOTE: Motion/second by CM Sanders/Cook to approve the Power Sales Agreement <br />between the City of Colton and America Utility Network carried upon unanimous vote <br />PUBLIC HEARINGS: <br />Wind -Powered Generators <br />This was the time and place fixed to consider adding Chapter 18.45 to the Colton Municipal Code <br />relating to wind powered generators and windmills. <br />I Mayor Gaytan declared the Public Hearing "open." <br />Deputy City Clerk Delgado informed that the Affidavit of Publication calling the Public Hearing <br />was on file in the City Clerk's Office and announced that she did not receive any protests or <br />objections. <br />Community Development Director Zamora recapped the agenda report of June 17, 1999 and <br />recommended passage of the proposed ordinance. <br />The following citizens commented on the issue: Caroline Dyer, Pam Pandza and William Yahn. <br />MOTION/VOTE: Motion/second by CM Cook/Chastain to terminate the Public Hearing carried <br />upon unanimous vote. <br />Motion made by CM Sanders, seconded by CM Bennett, to waive full reading and pass first <br />reading of Ordinance No. 0-13-99 carried upon unanimous vote. <br />City Attorney Carvalho provided the following information for purposes of clarification: The <br />City Attorney's Office has had ongoing meetings with Mr. Vine and his attorney and there is <br />progress, with options to be discussed tonight with City Council in Closed Session. Having <br />checked with the Planning Department and the building inspectors, City Attorney Carvalho <br />assured that the structures had been inspected for safety and they met all existing uniform building <br />code standards.
