City Attorney Carvalho advised that legally the City of Colton could revoke a permit that had <br />been issued but the City was then obligated to pay the individual who received that permit for <br />damages that he/she incurred as part of the process. She indicated that the attorneys were <br />attempting to identify those issues. <br />Finally, City Attorney Carvalho informed that Mr. Vine's lawyer had represented that the City of <br />Colton did not have the authority to regulate these types of items because of some preemption <br />issue under State statute. After three weeks of extensive research and numerous telephone calls, <br />City Attorney Carvalho stated that opposing Counsel, Ms. Titall, was not able to provide the <br />statute. <br />At 7:03 P. M., CM Chastain and CM Bennett removed themselves from their places at the dais. <br />Land Use Designation <br />This was the time and place fixed to consider the negative declaration for minor amendment of <br />circulation element of General Plan to allow the City to study and consider the future possible <br />realignment and widening of Agua Mansa Road. <br />Mayor Gaytan declared the Public Hearing "open." <br />Deputy City Clerk Delgado informed that the Affidavit of Publication calling the Public Hearing <br />was on file in the City Clerk's Office and announced that she did not receive any protests or <br />objections. <br />Community Development Director Zamora summarized his report dated June 10, 1999 and <br />recommended approval of File Index Number DZG-11-99. Staff recommended approval of the <br />proposed Resolution and for passage of the proposed Ordinance. <br />MOTION/VOTE: Motion/second by CM Cook/Sanders to terminate the Public Hearing carried <br />with CM Chastain and CM Bennett absent. <br />At 7:08 P. M., CM Bennett returned to her place at the dais. <br />Motion/second by CM Sanders/DeLaRosa to approve and adopt RESOLUTION NO. R-53-99 <br />and to waive full reading and pass first reading of ORDINANCE NO. 0-14-99 carried with CM <br />Chastain absent. CM Bennett abstained from voting, as she was not present for this matter. <br />ORDINANCE: <br />SECOND READING: <br />MOTIONNOTE: Motion/second by CM Cook/Bennett to waive full reading and pass second <br />reading of ORDINANCE NO. 0-10-99 carried with CM Chastain absent. <br />PUBLIC COMMENT <br />City Council Mins July 6, 1999 3 <br />
