with the public welfare; or, that the Rocks Club had been conducted in an illegal, improper or <br />disorderly manner. <br />She announced that there would be witnesses and the taking of testimony, along with cross- <br />examination, and she stated that the Mayor Pro Tempore would act as the presiding officer of the <br />hearing and would render any necessary procedural rulings concerning the conduct of the <br />proceedings. City Attorney Sonia Carvalho would act as attorney for the City Council, also the <br />Administrative Body. <br />The following citizens commented on the Administrative process: William Yahn and Jeff Wright. <br />Attorney Kevin Collins presented an Opening Statement on behalf of the City. Roger Diamond, <br />Attorney for Olympia Grill and Lounge dba Rocks Club, presented an Opening Statement on <br />behalf of the Rocks Club. <br />On the matter of revocation of the Dance Permit, the following acts and/or omissions by the <br />Rocks Club were raised: <br />(1) The illegal and improper acts that have occurred at the Rocks Clubs since the issuance <br />of its Dance Permit, including, but not limited to, the shooting that occurred on May <br />13, 1999, the fight between approximately 30 patrons that occurred on April 25, <br />1999, and the vandalism to a vehicle that occurred on May 11, 1999; <br />(2) The Rocks Club's failure to provide the Chief of Police of the City with a list of all <br />security guards which may be assigned to the club during any month as required by <br />the letter agreement dated March 16, 1999; <br />(3) The Rocks Club's failure to provide to the City Clerk for recording with the County <br />of San Bernardino, the reciprocal parking agreements required by the letter agreement <br />dated March 16, 1999; and, <br />(4) The Rocks Club's failure to pay the administrative costs incurred by the City in <br />monitoring and ensuring that proper security measures are taken at the Rocks Club as <br />required by the letter agreement dated March 18, 1999. <br />A packet, identifying Exhibits A through I, was presented to the Administrative Board Members. <br />The following witness was sworn and examined: <br />(1) David Zamora, Community Development Director <br />Following a line of questioning regarding the issuance of the permit, City Attorney Carvalho <br />informed that the City Council had been advised by the City Attorney, when they considered the <br />original application for the dance permit, that if the applicant met certain conditions that the City <br />Council lacked some discretion with respect to issuing the permit and they viewed this permit as a <br />regulatory permit to protect the health, safety and welfare of the residents.
